End User License Agreement

1. License Grant

SportPulse grants you a personal, non-exclusive, non-transferable, limited license to use the SportPulse application on devices you own or control, strictly in accordance with these terms.

2. Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the application.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the application.
  • Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of SportPulse or its affiliates.

3. Intellectual Property

The application, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of SportPulse.

4. Termination

This Agreement shall remain in effect until terminated by you or SportPulse. SportPulse may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SportPulse be liable for any special, incidental, indirect, or consequential damages whatsoever.

6. Apple App Store Terms

This Agreement is between you and SportPulse only, and not with Apple, Inc. SportPulse, not Apple, is solely responsible for the application and the content thereof.

  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.
  • In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any).
  • Apple is not responsible for addressing any claims by you or any third party relating to the application.
