Terms of Service

1. Contracting Entity

These Terms of Service are between you and SportPulse, the operator of the SportPulse platform ("SportPulse", "we", "us", or "our"). If you use SportPulse on behalf of a venue, academy, organizer, team, employer, or other organization, you confirm that you have authority to bind that organization.

2. Acceptance

By accessing or using SportPulse, creating an account, booking a court, joining a game, organizing a tournament, using coaching tools, purchasing a subscription, using partner tools, uploading content, or otherwise using the service, you agree to these Terms and all policies referenced in them.

If you do not agree, do not use SportPulse.

If there is a conflict, the more specific policy controls for the relevant feature, unless prohibited by law.

4. What SportPulse Does

SportPulse provides software and platform tools for badminton and related sports activity, including:

• Account, profile, discovery, and community tools.
• Venue discovery, facility details, court booking, schedule, offer, and partner workflows.
• Game hosting, joining, waitlists, team generation, and scorekeeping.
• Tournament creation, registration, teams, fixtures, stages, scoring, standings, sponsors, and organizer dashboards.
• Coaching organization, student, guardian, attendance, assessment, report, and report-sharing tools.
• Ratings, analytics, history, subscriptions, premium entitlements, notifications, support, and moderation.

SportPulse may facilitate real-world services offered by venues, organizers, coaches, academies, or other users. Unless expressly stated, SportPulse is not the venue, organizer, coach, academy, transport provider, insurer, medical provider, payment issuer, or safety supervisor.

5. Eligibility and Minors

You must be legally capable of entering into these Terms. If you are under 18, you may use SportPulse only with consent and supervision from a parent or legal guardian.

If you are a parent, guardian, coach, academy, organizer, or venue representative who creates or manages a minor's information, you represent that:

• You have authority to do so.
• You will provide accurate information.
• You will ensure participation is appropriate for the minor's age, health, skill, and safety.
• You will comply with child protection, privacy, coaching, venue, school, academy, and sports safety obligations.

6. Accounts and Security

You agree to:

• Provide accurate, complete, and current account information.
• Keep your login credentials secure.
• Not share your account except where SportPulse expressly supports team, staff, guardian, or organization access.
• Notify SportPulse promptly of unauthorized access or suspected security issues.
• Use your own legal identity unless a permitted role or organization account applies.

You are responsible for activity under your account unless caused by SportPulse's breach of legal duties.

7. User Roles

SportPulse supports different roles, including players, hosts, co-hosts, scorers, venue staff, venue admins, partner admins, coaches, academy staff, guardians, tournament organizers, tournament staff, and platform admins. Your access may depend on your role, verification, subscription, entitlements, approval status, or invitation.

You must not use a role, permission, or admin workflow unless you are authorized to do so.

8. Acceptable Use

You must not:

• Harass, threaten, abuse, stalk, bully, exploit, or endanger anyone.
• Upload illegal, defamatory, hateful, obscene, sexually explicit, violent, fraudulent, misleading, or infringing content.
• Impersonate another person, venue, organizer, coach, academy, staff member, sponsor, or SportPulse representative.
• Manipulate scores, ratings, rankings, reputation, waitlists, bookings, tournaments, reviews, analytics, subscriptions, or payments.
• Create duplicate, fake, or evasive accounts.
• Use SportPulse for betting, match fixing, fraud, scams, illegal payments, or unlawful promotions.
• Scrape, crawl, harvest, reverse engineer, interfere with, overload, or bypass SportPulse systems.
• Attempt to access accounts, data, APIs, admin tools, venues, reports, student data, or payments without authorization.
• Upload malware or content designed to disrupt or compromise systems.
• Use SportPulse in a way that violates law, platform rules, venue rules, or these Terms.

9. Real-World Sports Activity

Sports activity involves risk. You are responsible for deciding whether you are fit to participate, using appropriate equipment, following venue rules, warming up, respecting safety instructions, and stopping activity if unsafe.

SportPulse does not provide medical advice, emergency services, player supervision, professional coaching certification, injury prevention guarantees, or insurance unless expressly stated.

10. Venues, Bookings, and Real-World Services

Venue listings, court details, availability, pricing, facilities, rules, amenities, offers, photos, schedules, cancellation rules, and service quality may be provided by venue partners or staff. You should review details before booking.

SportPulse may help process bookings, payments, confirmations, cancellations, refunds, and disputes, but venue-specific rules may apply. Venue partners remain responsible for lawful operation, accurate listing information, safe premises, staff conduct, facility availability, and compliance with applicable permits and regulations.

11. Games

Game hosts are responsible for setting accurate game details, venue/location, start and end time, capacity, fee per player, approval settings, skill expectations, and rules. Participants are responsible for joining only when they intend to attend, paying applicable amounts, following host and venue rules, and respecting other players.

SportPulse may restrict users for repeated no-shows, late cancellations, unfair play, score manipulation, abuse, or unsafe behavior.

12. Tournaments

Tournament organizers are responsible for tournament legality, rules, eligibility, schedule, venue access, scoring format, category rules, sponsor rights, participant communications, staff conduct, safety planning, cancellation handling, and compliance with applicable law.

SportPulse may provide tournament software and discovery tools but does not guarantee tournament quality, prize delivery, sponsor performance, schedule accuracy, or organizer conduct unless expressly stated.

13. Coaching and Student Workflows

Coaches and academies are responsible for qualifications, training environment, student safety, guardian consent, attendance records, injury-note accuracy, report sharing, and lawful handling of student data.

SportPulse coaching tools are operational software, not a substitute for professional judgment, medical advice, safeguarding practices, emergency procedures, or legal compliance.

14. Scores, Ratings, Rankings, Reputation, and Analytics

SportPulse may calculate or display player ratings, skill labels, badges, reputation signals, match history, standings, analytics, team suggestions, scheduler outputs, recommendations, and discovery boosts.

These outputs may be affected by incomplete data, incorrect scores, venue conditions, participant behavior, manual edits, algorithmic assumptions, or technical issues. They are provided for product and community purposes and should not be treated as official sports federation rankings, employment decisions, school decisions, medical assessments, or financial advice.

You must not manipulate scores, ratings, reputation, reviews, badges, analytics, or recommendations.

15. User Content

"User Content" includes anything you upload, submit, post, send, display, or create through SportPulse, including profile photos, messages, reviews, game descriptions, tournament rules, logos, banners, sponsor content, venue images, coaching notes, student reports, comments, and support materials.

You retain ownership of your User Content, but you grant SportPulse a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, distribute, adapt, modify, create derivative works from, and use your User Content as needed to operate, improve, promote, moderate, secure, and provide SportPulse.

You represent that:

• You have the rights needed to submit the User Content.
• The content is accurate where factual.
• The content does not violate law, privacy rights, intellectual property rights, publicity rights, venue rights, sponsor rights, child-safety rules, or these Terms.
• You have necessary consent for any personal data, image, name, logo, brand, sponsor material, student data, or guardian contact information included in the content.

16. Content Moderation

SportPulse may review, remove, hide, restrict, label, preserve, investigate, or report content or accounts if we believe it may violate law, rights, safety, platform policies, venue rules, app-store policies, or these Terms.

We may use reports, automated signals, manual review, user blocks, staff notes, abuse histories, and other context to make moderation decisions. We are not required to publish every reason for a moderation action if doing so would compromise safety, security, privacy, fraud prevention, or legal compliance.

17. Subscriptions, Paid Features, and Promotion Boosts

SportPulse may offer free features, recurring subscriptions, add-ons, one-time products, manual entitlements, or promotional access. Paid features may include analytics, history, alerts, watchlists, organizer tools, coaching reports, partner reporting, venue intelligence, and promotion boosts.

Digital subscriptions and in-app digital entitlements are governed by Subscription and Billing Terms. Real-world bookings, tournaments, and coaching services are governed by the specific service terms and refund policy.

Promotion boosts may affect visibility or placement but do not guarantee views, joins, registrations, bookings, revenue, or results.

18. Payments, Taxes, Refunds, and Payouts

You agree to pay all applicable charges, taxes, fees, booking amounts, subscription charges, add-ons, and payment-provider charges shown to you before purchase or otherwise agreed.

Refunds and cancellations are governed by Cancellation, Refund, and No-Show Policy, app-store rules, payment-provider rules, and applicable law.

Venue and partner payouts, invoices, platform fees, taxes, and reconciliation are governed by Venue / Partner Terms and any separate commercial agreement.

19. Third-Party Services

SportPulse may integrate with third-party services, including app stores, payment processors, authentication providers, maps, cloud hosting, notifications, analytics, email, SMS, support tools, and venue or organizer systems. Their terms and privacy policies may apply.

SportPulse is not responsible for third-party services except as required by applicable law or expressly agreed in writing.

20. Intellectual Property

SportPulse owns or licenses the platform, software, APIs, designs, trademarks, logos, content, data models, compiled data, workflows, and documentation, excluding User Content and third-party content. You may not use SportPulse marks without prior written permission.

Feedback, suggestions, and ideas you provide may be used by SportPulse without restriction or compensation, unless prohibited by law.

21. Suspension and Termination

We may suspend, restrict, or terminate access if:

• You breach these Terms or related policies.
• Your conduct creates legal, safety, security, payment, fraud, or platform risk.
• A venue, organizer, coach, guardian, authority, or user raises a serious concern.
• Required payments fail or are reversed.
• We discontinue a feature, app, or service.
• We are required by law, app-store rules, payment-provider rules, or a legal process.

You may stop using SportPulse at any time and may request account deletion as described in the Account Deletion and Data Rights Notice.

22. Disclaimers

To the maximum extent permitted by law, SportPulse is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, venue availability, booking acceptance, tournament performance, coaching quality, partner payouts, player attendance, safety outcomes, ranking accuracy, analytics accuracy, or commercial results.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

23. Limitation of Liability

To the maximum extent permitted by law, SportPulse and its affiliates, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, injury arising from third-party conduct, venue failures, player conduct, organizer conduct, coach conduct, or unauthorized access not caused by SportPulse's breach of legal duty.

Where a liability cap is permitted by law, SportPulse's aggregate liability for claims arising from or relating to SportPulse will not exceed the greater of INR 1,000 or the amount you paid directly to SportPulse for the affected paid service during the three months before the event giving rise to the claim. This cap does not limit liability that cannot be limited under applicable law.

24. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless SportPulse from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your breach of these Terms.
• Your User Content.
• Your real-world sports activity.
• Your misuse of bookings, payments, organizer tools, venue tools, coaching tools, student data, reports, or user data.
• Your violation of law, venue rules, third-party rights, or platform policies.

For consumers, this clause should be interpreted only to the extent permitted by applicable law.

25. Changes to SportPulse or These Terms

We may modify SportPulse features or these Terms from time to time. Material changes may be communicated through the app, website, email, or other reasonable method. Continued use after changes become effective means you accept the updated Terms.

26. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable consumer law, mandatory jurisdiction rules, and rights that cannot be waived, competent courts in India will have jurisdiction.
